Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Survision mobile application, website, and related services (collectively, the "Platform"), owned and operated by SARL SURVISION DATA, a company registered in Algeria, with its registered office located at Villa Elder N°24, Bureau N°04, Sous-sol, Boumerdes, and accessible online at survision.io ("Survision," "we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

Part A: General Terms Applicable to All Users

1. Definitions

  • "Client" means a legal entity that uses the Platform to commission Market Research Projects.
  • "Collector" means an individual registered as an 'Auto-Entrepreneur' under Algerian law who uses the Platform to accept and perform Data Collection Tasks.
  • "User" means any party using the Platform, including Clients and Collectors.
  • "Market Research Project" means a research project commissioned by a Client through the Platform.
  • "Data Collection Task" means a specific assignment within a Market Research Project that a Collector can accept to perform.
  • "Collected Data" means all data, information, responses, photographs, audio recordings, and other materials gathered by a Collector during a Data Collection Task.

2. Acceptance of Terms

Your access to and use of the Platform is conditioned on your acceptance of and compliance with these Terms, our Privacy Policy, and any additional terms applicable to specific services. By creating an account or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. You further agree that your electronic assent, such as clicking "I Agree," constitutes your electronic signature and is the legal equivalent of your manual signature on this agreement, in accordance with Algerian Law No. 15-04.

3. Platform License

Subject to your compliance with these Terms, Survision grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to: (i) access and use the Platform on your personal device solely in connection with your use of the services; and (ii) access and use any content, information, and related materials that may be made available through the Platform, in each case solely for your personal, non-commercial use unless otherwise agreed in writing.

4. Acceptable Use Policy

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any Algerian law.
  • Decompile, reverse engineer, or disassemble the Platform.
  • Provide false or misleading information during registration or use of the Platform.
  • Infringe upon the intellectual property rights of Survision or any third party.
  • Harass, abuse, or harm another person through the Platform.

5. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available." Survision disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms. To the fullest extent permitted by Algerian law, Survision shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, or property damage related to, in connection with, or otherwise resulting from any use of the Platform.

6. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Democratic Republic of Algeria. In the event of a dispute arising out of or in connection with these Terms, the parties shall first attempt to resolve the dispute through amicable negotiations. If the dispute is not resolved within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the competent courts of Boumerdes, Algeria.

Part B: Service Agreement with Data Collectors ('Auto-Entrepreneurs')

This Part B, in conjunction with Part A, forms the service agreement ("Collector Agreement") between Survision and you, the Collector.

1. Nature of the Relationship

This Agreement establishes a business relationship between two independent entities: Survision, as a service provider, and you, the Collector, as an independent contractor. Nothing in this Agreement shall be construed as creating an employment relationship, partnership, or joint venture between you and Survision. You are not an employee of Survision and are not entitled to any of the rights or benefits afforded to Survision's employees.

2. Eligibility and Obligations

2.1. 'Auto-Entrepreneur' Status:

You represent and warrant that you are of legal working age in Algeria and that you are, and will remain for the duration of this Agreement, validly registered as an 'Auto-Entrepreneur' in accordance with Algerian Law No. 22-23. You agree to provide Survision with a copy of your 'Auto-Entrepreneur' card upon request.

2.2. Onboarding and Verification:

You agree to provide accurate and complete information during the onboarding process and consent to Survision verifying your identity through the documents you provide. Successful verification is a prerequisite for accessing Data Collection Tasks.

2.3. Professional Conduct:

You agree to perform all Data Collection Tasks in a professional, ethical, and diligent manner, strictly adhering to the instructions provided for each task and complying with all applicable laws, including Law No. 18-07 on data protection.

2.4. Confidentiality:

You shall treat all information related to Market Research Projects, Client identities, survey methodologies, and Collected Data as strictly confidential. You shall not disclose this information to any third party without Survision's prior written consent.

2.5. Equipment and Expenses:

You are responsible for providing and maintaining, at your own expense, the necessary equipment to perform the Data Collection Tasks, including a modern smartphone with a reliable internet connection. You are solely responsible for all costs and expenses incurred in the performance of your services.

2.6. Taxes and Social Security:

As an independent contractor, you are solely responsible for declaring your income and paying all applicable taxes and social security contributions (CASNOS) as required by Algerian law. Survision will not withhold any amounts for taxes or social security.

3. Remuneration

You will be compensated for each successfully completed and validated Data Collection Task at the rate specified in the task description on the Platform. Payment will be made to the commercial bank account you have registered on the Platform, in accordance with the payment schedule detailed therein. You are responsible for issuing any invoices required by law.

4. Intellectual Property Assignment

This clause is a fundamental and essential part of this Agreement.

4.1. Assignment of Rights:

In consideration of the fees paid to you by Survision, you hereby irrevocably assign to Survision all right, title, and interest, including all economic rights of copyright and other intellectual property rights, in and to all Collected Data. This assignment is worldwide, for the full term of legal protection of such rights, and covers all known and future modes of exploitation. The rights assigned include, but are not limited to, the rights of reproduction, representation, adaptation, modification, distribution, and communication to the public.

4.2. Further Assurance:

You agree to execute any further documents and take any further actions that Survision may reasonably request to perfect, register, or enforce its ownership of the rights assigned under this clause.

4.3. Moral Rights:

To the extent permitted by law, you waive any moral rights you may have in the Collected Data, including the right of attribution, but you retain the right to the integrity of the work to the extent it protects your honor and reputation as per Algerian law.

5. Term and Termination

This Agreement commences upon your acceptance and continues until terminated.

5.1. Termination by You:

You may terminate this Agreement at any time by ceasing to use the Platform and deleting your account.

5.2. Termination by Survision:

Survision may terminate this Agreement or suspend your access to the Platform at any time, with or without cause, upon providing you with notice. Survision may terminate this Agreement immediately, without notice, if you breach any material term, including but not limited to the confidentiality or intellectual property clauses.

5.3. Effect of Termination:

Upon termination, you will be paid for all tasks completed and validated prior to termination. The clauses on Confidentiality, Intellectual Property Assignment, and Governing Law shall survive the termination of this Agreement.
